Law No. 9.575 providing for the environmental administrative process for investigating conduct and activities harmful to the environment, the applicable sanctions, in addition to dealing with environmental conciliation, under the Public Administration of the State of Pará.

This Law provides for the administrative environmental infraction process for investigating conduct and activities harmful to the environment, and provides for applicable sanctions, within the scope of the Public Administration of the State of Pará, and amends State Law No. 5.752 of 26 July 1993, and No. 5.887 of 9 May 1995. The state environmental agency, sectional coordinator of the National Environmental System (SISNAMA) and central body of the State Environment and Water Resources System (SISEMA) are responsible for: control and supervise the activities and undertakings whose responsibility to license or authorize, environmentally, is committed to the States, observing the provisions of art. 17 of Complementary Law No. 140 of 8 December 2011; draw up a notice of infraction; investigate environmental administrative infractions; apply precautionary administrative measures; apply administrative sanctions; carry out environmental reconciliation; and convert a simple fine into services for preserving, improving and recovering the quality of the environment. The sanctions imposed by the competent authority must be pedagogical in nature as a way of raising awareness among the offender. The sanctions provided for in items IV to XII may be applied cautiously by the inspection agent, as well as the custody or deposit of products, by-products and equipment, objects of seizure.
