Abstract
This Law establishes the modalities of public purchase, the rights and the duties, and also liability of the subjects of the aforesaid purchase, the modalities of supervision over public purchase and examination of dispute settlement. Public purchase shall be performed through tenders and shall be regulated by contracts. Produce subject to purchase must be certified and labeled with the specification of environmental impact indices, production processes and type of packaging. Services and works can also be purchased through unannounced negotiations, when from the same, when from the same supplier are performed purchases of new services or works similar to those purchased under the original contract, including foodstuffs when they are purchased from a short food supply chain. Public procurement includes also purchase of food supply services for schools (school feeding). The preliminary contract may not be concluded for a period longer than 4 years, except for reasonable cases related to the object of purchase, which are indicated in the purchase announcement or invitation to confirm interest. The purchase contract based on the preliminary contract can be concluded no later than before the expiration of the preliminary agreement, but the purchase agreement itself can be valid even longer. A purchase contract may be concluded verbally only when the value of the simplified purchase contract does not exceed EUR 15,000 (fifteen thousand euros) (without value added tax).
