Abstract
This Act establishes a legal framework for the protection and management of the environment within the territory, including its territorial waters and exclusive economic zone. It mandates a general duty for every person to take reasonably practicable measures to protect the environment and prevent pollution.
Central to the legislation is the regulation of "prescribed activities" listed in Schedule 1, which include industrial, agricultural, and infrastructure projects. Any person intending to undertake these activities must submit a written notification to the Authority, including an assessment of environmental impacts and mitigation measures as specified in Schedule 2. Work cannot commence until written approval is granted. Additionally, entities performing these activities must appoint an environmental officer to discharge specific duties under the Act.
The Act grants the Authority extensive enforcement powers, including the right to inspect premises, take samples, and issue remedial or stop-work orders in cases of environmental risk or non-compliance. Failure to comply with such orders can result in substantial fines, reaching up to $10,000,000, or imprisonment. The legislation also provides for the investigation of environmental incidents through an Inquiry Committee and allows the Authority to issue or approve codes of practice to provide guidance on environmental requirements.
