Decree of 25 February 2009 approving the simplified procedures for the authorization of water discharges and opening of wastewater treatment stations in application of Law No. 31/2008 on measures for economic recovery.

The objects of this Decree, in accordance with the general objectives established by the Law No. 31/2008 on economic recovery measures are: define the activities or type of facilities that may follow the simplified procedures to obtain authorization for the discharges provided in articles 30 and 37 and to obtain the authorization to open a wastewater treatment plant provided for in article 32 of the Law on Police and Water Protection, approved by the General Council on July 31, 1985; define activities or type of facilities that can have a very negative impact on the environment, especially on waters, which must obtain the corresponding authorization through the current ordinary procedure; define the simplified procedure and the ordinary procedure for obtaining the aforementioned authorizations; define the limits (quantitative, qualitative and valid, among others) of the authorizations derived from the simplified procedures; establish the self-checks to which the activities and facilities must be subject to in accordance with articles 30, 32 and 37 of the Law on police and water protection. Four Annexes deal with the following issues: List of activities that do not take into account activities that may have a Very negative impact on the environment, especially on water; Documentation necessary to obtain the corresponding authorization. Application to obtain the authorization provided for in articles 30, 32 and 37 of the Law on police and water protection; Quantitative and qualitative limits of dumping authorizations granted by the Government that have followed the simplified procedure.
