Decree 291/2024, of 17-7-2024, which approves the regulation prohibiting the destruction of unclaimed items.

This Decree approves the Regulation prohibiting the destruction of unclaimed items, the purpose of which is to establish the list of newly invented items that are suitable for non-food consumption, the destruction of which through energy recovery or disposal is prohibited.
The Regulation establishes that producers and distributors of consumer products, including retail or wholesale commercial activities, including online commerce, may not destroy or dispose of non-food items fit for consumption. If they wish to dispose of these items, they must opt for resale or donation and, as a last resort, material recovery through recycling through a waste manager.
Some exclusions are foreseen for: a) Items whose reuse and recycling pose a risk to health and safety. b) Items for which reuse or recycling is not feasible due to the fact that they are obsolete items or that there are no adequate facilities to recycle them, or items that do not comply with current approvals or certifications in accordance with applicable regulations. c) Items confiscated by the competent authorities or subject to specific sectoral regulations.
