Abstract
This Decree approves the Regulation which aims to define the content of environmental impact studies and restoration plans and environmental monitoring plans for projects, as well as of strategic environmental studies for plans and programmes.
1. In accordance with Law 4/2023, the environmental impact study identifies, describes and evaluates the significant direct and indirect effects of a project on the following factors: a) Population and human health. b) Biodiversity, with special attention to protected species and habitats of interest. c) Land, soil, water, air and climate. d) Material assets, cultural heritage and landscape. e) The interaction between all of the above factors.
The environmental restoration plan is the technical document that, based on the identified environmental impacts, plans the necessary work to carry out the preventive, corrective or compensatory measures, both during the works and once the project is executed and in operation.
The environmental monitoring plan is the environmental technical document that establishes the procedure for monitoring the proper execution and effectiveness of the preventive, corrective or compensatory measures described in the environmental restoration plan.
The strategic environmental study is a technical document integrated into the plan or programme subject to strategic environmental assessment that identifies, describes and evaluates the likely significant effects that the application of the plan or programme may have on the environment, as well as reasonable alternatives, including the alternative of not altering the environment, which take into account the objectives and the geographical scope of application of the plan or programme, and proposes guidelines for the monitoring and supervision of the plan or programme and to prevent, reduce and compensate, whenever possible, any significant negative effects on the environment that may result from the application of the plan or programme.
