Abstract
Decree 75/2024, of 21-2-2024, which approves the regulation relating to the conditions for authorizing the exploitation of water abstractions intended for human consumption.
For these purposes, the following are established: 1. The technical criteria for the exploitation of the water catchment for human consumption and the installations that form part of the catchment. 2. The criteria for carrying out its protection, control and surveillance. 3. The criteria for the registration of water catchments intended for human consumption. 4. The powers and respective responsibilities of all public and private agents and/or bodies that carry out activities related to the exploitation of water catchments intended for human consumption.
This Regulation applies to all waters intended for human consumption; are instead excluded from its scope of application: 1. Bottled waters that are designated as waters with natural mineral properties or with mineral-medicinal properties intended for human consumption. 2. Water intended exclusively for uses for which the competent health authority is satisfied that its quality does not directly or indirectly affect people's health. 3. Water that flows from natural springs that are for public use and access. However, in order to avoid disorders to people's health, any public spring not connected to a public water supply network must display a sign with the following statement: “Untreated water.”
Chapter 2 establishes the requirements for the abstractions and regulates the Technical Commission for Water intended for human consumption, whose functions are: a) Coordinate the application of sectoral regulations, in relation to the authorization of the exploitation of water abstractions for human consumption. b) Develop protocols to coordinate interministerial work, periodically review existing protocols and establish improvement proposals where appropriate. c) Create working groups designated by each ministry with a view to:- Carry out the analysis of the documentation that makes up the administrative file and carry out, where appropriate, the corresponding checks, in order to issue the respective technical reports in accordance with the provisions of this Regulation. Instruct, in accordance with the provisions of articles 9, 10 and 11 of this Regulation, the management of administrative authorization files, register them in the corresponding register, and make entries for any registry changes that may occur. d) Disseminate and facilitate the data contained in the corresponding registers. e) In general, ensure the application and respect of this Regulation and other concurrent regulations that are within its competence. f) Report on the abstraction of water for human consumption with regard to the applicable sectoral regulations.
The text moves forward regulating the authorization and registration of the exploitation of water abstractions intended for human consumption and describing the powers and actions of the different administrations.
