Abstract
This document is the official publication of Andorra's Consolidated Law 16/2022, which establishes a comprehensive legal framework for a government program aimed at: promoting the renovation and modernization of the existing building stock; improving the energy efficiency of buildings; encouraging the use of renewable energy sources.
The law consolidates and updates previous legislation (notably Law 21/2013 and its subsequent amendments) to create a single, coherent text, repealing all prior conflicting provisions.
The program has in its scope most existing and new buildings, with specific exclusions such as certain industrial facilities, temporary constructions, and very small buildings (<50 m²).
The law defines a wide range of eligible actions, including: improving accessibility and removing architectural barriers; enhancing thermal and acoustic insulation; improving sustainability and energy efficiency; renovating façades, interior courtyards, and roofs; installing renewable energy systems. Certain actions are explicitly excluded, such as routine maintenance, structural gutting (with exceptions), increasing building volume (unless necessary for eligible works), and works on protected cultural heritage without authorization.
Both physical and legal persons, including building owners and homeowners' associations, can apply for aid, provided they hold a legal title to the property. The program primarily offers direct subsidies and preferential loans guaranteed by the government. The maximum subsidy cannot exceed 60% of the eligible cost. A special bonus of up to 15 additional percentage points is available for renovations of homes that are subsequently introduced into the rental market for primary and permanent residence.
The Office of Energy and Climate Change is responsible for managing the program, advised by a newly created Technical Rehabilitation Commission (CTR). The law includes provisions on guarantees, the consequences of non-compliance (including the requirement to repay aid with interest), and links responsibilities and sanctions to existing laws on urban planning and industrial safety.
In summary, this consolidated law aims to stimulate the construction sector, generate wealth, and promote sustainability by providing a clear and updated framework of financial incentives for building renovation, energy savings, and the adoption of renewables in Andorra.
