Cabinet Resolution No. 84 of 2022 regarding the Executive Regulations of Federal Law No. 9 of 2020 regarding Biosafety of Genetically Modified Organisms and their products.

This Resolution comprises 14 articles and 6 annexes. Article 2 outlines the rules for the reproduction, crossing, and circulation of genetically modified organisms (GMOs) or their products, stipulating that: (i) first-time import of GMOs or their products must comply with relevant annex requirements based on the import purpose, submit various risk assessment and response plans, and secure the ministry's approval, registration, and verification of no adverse effects on human health and the environment; (ii) at border crossings, the transit of GMOs or their products requires authorization from the competent authority in the source country, with officials authorized to inspect and verify documents for any transiting, unloading, or reloading shipments; (iii) the transit of GMOs or their products must use special carriers that meet technical, environmental, health, and safety standards, with all shipment documents attached, and containers must be sealed by customs to prevent the addition of other shipments. Article 3 addresses the conditions and controls for exporting or re-exporting GMOs or products. Article 4 outlines the requirements and conditions for their release and isolated use, including obtaining authorization from the competent authority, fulfilling annex requirements based on the usage purpose, conducting risk assessments and management plans, ensuring registration with the ministry, complying with health and safety standards, providing regular reports, and ensuring the release location is suitable and poses no risks to human health or the environment. Article 5 establishes a record with the Ministry to register facilities and all operations concerning GMOs, including production, circulation, export, re-export, importation, and transit. Article 6 details the obligations of the responsible facility regarding permits, registration, information to the Ministry, and data cards (dealt with in detail in article 7). Article 9 focuses on monitoring, inspection, and surveillance of the release and circulation of GMOs.
The Annexes regard the following (1) the release of GMOs or their products; (2) circulation of GMOs or their products; (3) GMOs intended for food, feed or manufacturing use; (4) GMOs intended for isolated use; (5) monitoring and control system; (6) inspection system.
