Abstract
This Decree-Law consisting of 21 articles aims, for what concerns the development of the modern technology-based trade, to (i) achieve the State's strategic directions regarding digital transformation and attract investments and skills; (ii) develop the legislative and regulatory environment; (iii) stimulate this kind of trade for goods and services without differentiating between them and the goods provided through physical trade; (iv) organize the relationships between the digital trader and the consumer to achieve the following (a) protect consumer's interests, (b) protect data, (c) protect intellectual property rights regarding goods or services purchased through modern technology, (d) provide adequate technical protections to enable the consumer to purchase goods and services safely through modern technology, (e) provide secure digital payment methods and channels, in accordance with the technical and regulatory standards and requirements approved or specified by the competent authority. Under Article 4 the Ministry of Economy is responsible for the following functions (i) Policy Development and Supervision, proposing and setting general policies for modern technology-based trade, coordinating with the competent authority, and overseeing implementation; (ii) Consumer Protection, issuing terms and conditions to safeguard consumer interests; (iii) Regulation of Online Platforms, coordinating with relevant authorities to block smart applications, websites, or platforms that violate the Decree-Law or disrupt public order and morals; (iv) Tax and Customs Compliance, ensuring compliance with tax regulations and customs requirements by working with relevant authorities. Article 5 establishes that modern technology-based trade must comply with legal, regulatory, technical, and cybersecurity requirements, ensure consumer safety, transparency in pricing and digital contracts, sell only legally permitted goods or services, adhere to competition protection rules, provide digital invoices, follow marketing and data exchange regulations, prevent misleading practices, and supply requested information to authorities. Article 6 defines consumer rights, whereas Article 8 specifies their obligations.
The Decree-Law deals also with other topics such as (i) dispute settlement; (ii) data protection and information; (iii) insurance coverage which may be provided by digital traders and logistics or digital payment entities to mitigate risks associated with the trade, including logistics, digital payments, fraud, and hacking; (iv) supervision and control; (v) penalties.
