Abstract
This Law consisting of 13 articles aims at (i) ensuring a high level of protection for human and animal health, and environmental safety; (ii) ensuring proper handling and safe disposal of expired pesticides and their containers; and (iii) organizing the registration, import, re-export, circulation, use, advertisement, control and inspection of pesticides. The provisions of this Law shall apply to (i) pesticides, consisting of chemical pesticides, biological pesticides, or organic pesticides; (ii) active ingredients of the pesticide; and (iii) the additive for the pesticide, if sold separately to be used with the pesticide. The following shall be excluded from the application of the provisions of this Law (i) pesticides imported for use in scientific research purposes, or imported for the purpose of holding exhibitions, provided that the concerned authorities take safety measures and ensure that they are not circulated in the country; and (ii) pesticides that reach the country's ports and airports for the purpose of transit (transit).
Article 4 provides for the tasks undertaken by the Ministry of Climate Change and Environment which regard (i) establishment of a national plan for the safe use of pesticides; (ii) approvals or permits to import, release, re-export, and register pesticides (the Ministry may also authorize any governmental or private entity to do it); (iii) establishment of the maximum limits for the permissible percentage of pesticide residues in food products and feed; (iv) establishment of a central database in coordination with the competent authority to register and classify pesticides. While article 5 provides for the tasks of the competent authority, as follows (i) follow up the implementation of the provisions of this Law and the regulations issued for its implementation, and monitor the handling of pesticides; (ii) licensing the establishments operating in the field of pesticides after the approval of the Ministry; (iii) establish systems for training individuals to work in these areas; (iv) licensing pesticide stores; (v) control and inspection to ensure that licensed establishments adhere to safe handling of pesticides; (vi) disposal of damaged, adulterated and counterfeit pesticides or any pesticides that are decided to be disposed of safely; and (vii) grant permits to advertise any pesticide or pest control activity. Article 6 deals with prohibited actions, above all, but not limited to, relating to the import and export of pesticides.
