Abstract
This Law, consisting of 42 articles, aims to implement the CITES Convention by regulating the import, export, re-export, transit, and introduction from the sea of specimens of species listed in its Appendices through all border ports. Article 4 establishes the powers of the National Management Authority, designated within the Ministry of Climate Change and Environment, while Article 5 defines the responsibilities of the Scientific Authority, which is designated by a Cabinet resolution. The official border ports for the import, export, re-export, transit, handling, and introduction from the sea of species listed in the Appendices shall be designated by the National Management Authority, in coordination with relevant state authorities, under Article 6. The rules for import and export of specimens and consignments, as well as for introduction from the sea are generally consistent with CITES, but they introduce clearer procedural requirements and at least one stricter rule (transit permits, prohibited for consignments unless accompanied by a valid export or re-export certificate, while transit and trans-shipment are normally exempt from permit requirements if specimens remain under customs control) compared with the Convention text. Article 10 establishes that the National Management Authority may grant import, export, re-export, and introduction-from-the-sea certificates for specimens of listed species only after verifying scientific non-detriment findings, legal acquisition and prior import where applicable, compliance with transport and animal welfare standards, the existence of required import permits for Appendix I species, and that such specimens are not intended for commercial purposes. The Law (i) establishes that the possessor bears the burden of proving the lawful possession of listed species specimens; (ii) provides exemptions from certification requirements for non-commercial exchanges between registered scientific institutions; (iii) mandates the National Management Authority to regulate certification procedures for specimens involved in travelling zoos, circuses, and exhibitions. Articles 28–33 establish penalties for various violations of the provisions of the Law. Article 39 addresses specimens acquired before a species was listed in the Appendices. It provides that the Executive Regulations will establish the rules governing the possession of such specimens, including the conditions, procedures, and controls for their registration, thereby allowing authorities to recognize and regulate pre-existing holdings while ensuring compliance with conservation requirements.
