Law on Leasing Emirati (State-Owned) Lands.

This law regulates the leasing of state-owned (Emirati) lands in Afghanistan and establishes a comprehensive legal framework for their administration. It defines key concepts, scope, competent authorities, and the procedures governing the leasing of state land for agricultural, industrial, commercial, and other permitted purposes. The law sets out detailed rules on lease application, auction and non‑auction allocation, determination and payment of rent, guarantees, approval of contracts, and registration. It establishes the rights and obligations of lessors and lessees, including land use requirements, maintenance duties, and restrictions on transfer or misuse. Provisions are included on contract duration, renewal, amendment, and adjustment of rent, as well as conditions for early termination and contract rescission. Article 26 requires the lessee to promptly notify the competent agricultural authority of any damage, losses, or natural disasters affecting the leased land, enabling assessment and further action in accordance with the law. The law also regulates land restitution, compensation for damage, and liability arising from natural disasters or other losses affecting leased land. Clear institutional responsibilities are assigned to relevant ministries and authorities for implementation, supervision, and dispute handling.
