Abstract
This Act provides for the establishment of a free trade and processing zone in Antigua and Barbuda and makes provisions for its administration and management. The Act establishes and defines the composition of the Free Trade and Processing Zone Commission, as a body corporate with perpetual succession and a common seal, having capacity to acquire, hold, mortgage and dispose of property and land, to enter into contracts, to sue and be sued in its corporate name and to do all things necessary for the purposes of this Act. According to the Act, the Minister may declare any area acquired by the Commission as a free trade and processing zone. The Act empowers the Commission to develop and maintain any acquired land declared to be a free trade and processing zone, to provide for realisation of the following infrastructures necessary to improve free trade: roads and highways, electric generating plants, water lines and facilities of sewerage, installation and maintenance of a port. Other matters covered by this Act include: procedure for application and granting of a licence in a free trade zone; the minimum amount of investment to be made in the free trade and processing zone; unlawful or prohibited activities and related fines; incentives to licensed activities, including tax exemption; conditions for employment in a free trade area; protection of health and safety of employees; supply of water, electricity, sewerage, telecommunication or other services; guidelines for the protection and preservation of the environment; disposal of industrial and commercial waste in a free trade and processing zone; movement of goods in and out of a free trade and processing zone; Ministerial power to issue regulations.
