Abstract
An Act to provide for the extension of the limits of the territorial waters of Antigua and Barbuda and Redonda, to make provisions for contiguous, exclusive economic and fishery zones and for matters connected therewith or incidental thereto.
This Act comprises 24 sections. Provisions of sections 3 and 4 provide for the limits and methods of measurement of territorial waters. The areas of the sea which are on the landward side of the baselines of territorial waters are the internal waters (sect. 5). The seaward limits of the contiguous zone, the exclusive economic zone and the fishery zone are established respectively in sections 6, 7, and 8. In sections 9, 10, 11 and 12, the Act sets out the scope of Antigua and Barbuda's jurisdiction in territorial waters, exclusive economic zone and fishery zone. Negotiations shall be entered into in order to settle dispute related to the delimitation of maritime boundaries (sect. 13). A foreign vessel shall be entitled to enjoy the right of innocent passage in territorial waters (sect. 14-1). However, if this vessel is a warship, the right of innocent passage is subject to prior permission of the competent authority (sect. 14-2). Under special circumstances set out in section 15, the passage of a foreign vessel shall be deemed prejudicial to the peace, good order and security of Antigua and Barbuda. The issue of enforcement is addressed in section 16. Section 17 deals with immunity of a foreign ship and any person on board and flag state responsibility. For the purposes of the exercise of the jurisdiction of the courts, the territory of Antigua and Barbuda shall include the internal and territorial waters (sect. 18). Under section 19, the Minister is authorized to make regulations. Section 20 regulates the issue of offence and penalties.
