Abstract
This Criminal Law defines the criminal offences, sentencing and other measures taken against the perpetrators. Criminal offences are classified into crimes and contraventions. The distinction between them is always drawn in the provisions of the Special Part of the present Code. The Criminal Code is based on the Constitution of the Republic of Albania, general principles of the international criminal law, and international treaties ratified by the Albanian state. The criminal legislation is composed of this Code and other laws providing for criminal offences. The criminal legislation of the Republic of Albania is in charge of protecting the state’s dependence and the entirety of its territory, human’s dignity, human rights and freedoms, constitutional order, property, environment, Albanians’ cohabitation and well-understanding of Albanians with national minorities, and religious cohabitation against the criminal offences, as well as of the latters’ prevention. The Criminal Code is based on the constitutional principles of rule of law, equality under the law, fairness in determining the guilt and sentence, protecting the highest interest of children, and the humanism. The implementation of the criminal law by analogy shall not be allowed.
This text also sets certain specific rules regarding environmental crimes (offences and penalties (example: Article 157 Destruction of the watering system; Article 159 Destruction of water-supply system; Article 200 Occupation of land; Article 201 Air pollution; Article 202 Transportation of toxic waste; Article 203 Pollution of waters; Article 204 Prohibited fishing; Article 205 Unlawful cutting of forests). Also in Article 207 (Breach of quarantine for plants and animals) Breach of rules of quarantine for plants or animals, when it has led to serious consequences which are either material or which bring serious danger to the life and health of people, constitutes criminal contravention and is punishable by a fine.
The text is divided main Parts, each with its thematic Chapters and a total of 335 articles. Titles of these Chapters (Chapters have their correlated Sections and sub-sections) are as follows: “Part I” Chapter I. General part; II. Criminal liability; III. Attempt; IV. Complicity of persons in committing criminal offences; V. Punishments; VI. Determination of punishment; VII. Alternatives to imprisonment sentences; VIII. Lapse of criminal prosecution, punishments and their nonexecution. “Special Part” Chapter I. Crimes against humanity; II. Criminal offences against the person, crimes against life; III. Criminal acts related to property or in the economic area; IV. Criminal acts against environment; V. Crimes against independence and constitutional order; VI. Crimes encroaching relations with other states; VII. Acts of terrorist intention; VIII. Crimes against the State authority; IX. Criminal acts against justice; X. Criminal acts affecting free elections and the democratic system of elections; XI. Criminal acts committed by an armed gang or criminal organization.
