Abstract
This Law establishes the requirements and technical mechanisms for the expansion of renewable energy sources within the national energy sector. It defines the roles and responsibilities of state institutions, including the Ministry responsible for energy and the Energy Regulatory Authority, in managing a diversified energy portfolio consisting of solar, wind, biomass, and geothermal resources.
The Law officially recognizes Renewable Energy Communities and it allows local authorities, small-scale farmers, and rural inhabitants to create autonomous legal entities to produce, share, and sell electricity. These provisions are designed to retain financial resources within local economies, improve the reliability of the power supply in remote areas, and reduce the operational costs of agricultural activities through the adoption of self-consumption technologies.
From an environmental perspective, the Law introduces rigorous sustainability and greenhouse gas emission saving criteria that govern the entire lifecycle of renewable fuels. It mandates that energy production must not infringe upon land with high biodiversity, such as primary forests, protected areas, or peatlands, thereby ensuring that the transition to green energy does not result in the degradation of natural ecosystems. Furthermore, the Law promotes the reduction of air pollutants and carbon emissions by incentivizing the replacement of fossil fuels in the transport and heating sectors with verified renewable alternatives. To ensure ecological integrity, it requires independent verification systems and a mass balance approach to track the environmental attributes of energy units from production to final consumption.
The implementation of this Law is supported by a net-billing scheme for installations up to 500 kW, providing a financial mechanism for rural households and businesses to offset their energy costs. Through the reduction of bureaucratic requirements for smaller projects, the legislation democratizes access to the energy sector for local participants who lacked the resources to navigate complex licensing. Additionally, it formalizes the "Guarantees of Origin" system, which provides a transparent method for certifying the renewable nature of energy, thereby fostering a market that values environmental conservation as a core economic commodity.
