Abstract
The Law aims to encourage and attract strategic investments, domestic and foreign, in the sectors of the economy, identified by this Law as strategic sectors, through the establishment of special administrative procedures aimed at favouring, facilitating or accelerating support and services to investors. This Law defines the procedures and rules that state bodies apply for review, approval and support of strategic investments, domestic and foreign, that are realized in the Republic of Albania, as well as services to the involved investor. In order to attract strategic investments in Albania, the Albanian Investment Development Agency (AIDA) can develop or purchase services promotion. The state can be represented in international markets for strategic investments also through agents international investments. Through the Agency, the state signs representation agreements with agents of other similar international investment agencies, whose service will be compensated in case of success by investors themselves.
These provisions shall apply to all strategic investments, which are selected as such based on the criteria and according to necessary procedures here defined and in those economic sectors expressly defined as strategic investment sectors. Strategic investments are considered to be of public interest. Determination of interest public in the selection of a strategic investment is evaluated according to: a) investment value; b) time of realization of the investment; c) productivity and added value of the investment; d) opening new jobs; e) sectoral economic priority; f) regional and local economic development; g) developing or improving the conditions and standards for the production of goods and the provision of services; h) offering new technologies to increase competition and investment effectiveness; i) increasing the general level of safety and quality of life of citizens; j) environmental and consumer protection. Strategic sectors are considered: a) energy and mining sector; b) "Transport, electronic communications infrastructure and urban waste" sector; c) "Tourism (tourist structures)" sector; d) "Agriculture (large agricultural farm) and fishing" sector; e) sector "Technology and economic development zone"; f) priority development areas. The specific sub-sectors are determined by decision of Council of Ministers.
This Law is divided into eight main thematic Chapters and a total of 37 articles. Titles of these Chapters are as follows: I. General provisions; II. Strategic investments and selection evaluation criteria; III. Administrative bodies and structures; IV. Procedures for strategic investments; V. Assisted procedure; VI. Special procedure; VII. Support measures (also containing related administrative and disciplinary measures); VIII. Transitional and final provisions.
