Abstract
This Decision validates the Regulation on the import into the customs territory of the Eurasian Economic Union of plant protection products (pesticides). For the purposes of this Regulation, plant protection agents (pesticides) shall mean chemical and/or biological preparations (insecticides, rodenticides, fungicides, herbicides, anti-emergence agents and plant growth regulators, defoliants, desiccants) used to control plant pests and diseases, weeds, pests of stored agricultural products, as well as seeds dressing, pre-harvest drying, leaf removal and plant growth regulation. Import of the aforesaid substances and chemical agents shall be subject to licensing. Import by natural persons of plant protection means (pesticides) as commodities for personal use is prohibited. Placement of plant protection agents (pesticides) registered in accordance with the legislation of a member state under the customs procedure of release for domestic consumption is carried out when submitting license to the customs authority of a member state. Placement of unregistered plant protection agents (pesticides) under the customs procedure of release for domestic consumption is carried out upon submission of the conclusion (permit) to the customs authority of a member state. In order to obtain a license, legal entities and individuals registered as individual entrepreneurs shall submit to the authorized body of the member state in the territory of which the applicant is registered the documents and information specified in subparagraphs 1 - 5 of paragraph 10 of the Rules for issuing licenses and permits for export and (or) import of goods (Annex to Annex No. 7 to the Treaty on the Eurasian Economic Union as of 29 May 2014).
Furthermore, this Decision regulates the import into the customs territory of the Eurasian Economic Union of ozone depleting substances, hazardous waste, wild flora and fauna, medicinal raw materials, and species of wild fauna and flora covered by the Convention on International Trade in Endangered Species of Wild Fauna and Flora. Under Section 2.7, Table 1 lists the species of wild fauna covered by the CITES and Table 2 lists the species of wild flora covered by the CITES.
