Presidential Decree No. 172/23 approving the Regulation that establishes the Conditions and Procedures for Licensing the Exercise of Commercial Activity.

This Presidential Decree approves the Regulation establishing Conditions and Procedures for Licensing the Exercise of Commercial Activity. The Regulation, consisting of 41 articles divided into four Chapters and four Annexes, applies to the licensing of commercial activities of wholesale sales, retail sales, general trade, provision of commercial services, as well as commercial activities of indirect representation and with the necessary adaptations to any other commercial activities not regulated by special legislation. Licensing or authorization to carry out a commercial activity and provide commercial services is granted upon issuance of the Individual Commercial Permit in favor of a natural or legal person. This Commercial Permit is the commercial licensing document and entitles its holder to either carry out the activity of selling tangible goods or carrying out the activity of providing commercial services, and the licensing entity cannot issue autonomous or separate documents on the aforementioned Subjects. The Individual Commercial Permit must only be granted to the applicant who owns an establishment as an owner or tenant. The opening of establishments to carry out high-risk commercial activities is subject to the prior authorization licensing process.
