Abstract
This Presidential Decree approves the Regulation on damages responsibilities caused to Environment. The Regulation, consisting of 4 Chapters and 1 Annex, aims at establishing the responsibility for the risk or degradation of the environment, based on the principle of «polluter-payer», in order to prevent and repair damages caused to the environment, according to Environmental Law No. 5/98. This Regulation applies for any activity susceptible to cause damage to the environment and/or be a threat of damage. It establishes the obligation of civil insurance for all individuals or collective persons, who perform activities which may be dangerous or risky for the environment. It also specifies competent authorities, guarantees, offences and penalties for illegal activity. The Regulation is divided as follows: General provisions (Chap. I); Environmental responsibility (Chap. II); Competencies (Chap. III); Guarantees (Chap. IV). The Annex specifies fines to be paid for offenders.
