Abstract
This law is enacted to protect wine cultivation in Burgenland from damage caused by wild bird species, particularly starlings. Its primary objective is to establish a legal framework for the management and mitigation of bird related damage to vineyards. The law operates within the context of wildlife protection and agricultural sustainability, emphasizing the need for effective measures to safeguard agricultural interests while adhering to existing wildlife conservation regulations. The law outlines specific measures for the lethal control of starlings, permitting the selective shooting of individual birds only when necessary to protect vineyards. It prohibits the use of non-hunting weapons and restricts shooting to daylight hours. The document mandates that municipalities must conduct joint measures to deter birds, contingent upon certain conditions, including the maturity of the crops and the absence of alternative solutions to prevent significant damage. Implementation of the law involves municipalities coordinating with licensed hunting authorities and wildlife protection organizations. The text consists of 18 Articles.
