Abstract
The General Civil Code (ABGB) was enacted in 1811. It covers a wide range of civil law areas, typically divided into three main parts: 1) Law of Persons (Personenrecht), which deals with legal personality, capacity, domicile, family law (marriage, divorce, parentage, adoption, guardianship), and the protection of individuals; 2) Property Law (Sachenrecht), which regulates ownership, possession, usufruct, servitudes (easements), pledges, and other rights related to movable and immovable property; 3) Law of Obligations (Schuldrecht), governing contracts (general principles, specific types of contracts like sale, lease, loan), torts (civil liability for damages), unjust enrichment, and management of affairs without mandate.
OWNERSHIP AND PROPERTY RIGHTS. The second Part of the Civil Code concerns property rights. Firstly, it provides for the classification of things. Furher it sets out provisions on the acquisition of property, including possession. Servitudes are regulated under part VII of this second Part of the Code.
INHERITANCE. Part VIII of the second Part of the Code concerns the law of succession. Inheritance may be voluntary or on substitute and subsequent inheritance.
OBLIGATIONS AND CONTRACTS. Article 859 and subsequent provisions apply to obligations, including contracts such as purchase, loan, rental.
WATER. In the context of rela rights the Code contains several provision on water supply, waterworks, wastewater, waterbodies, water servitudes.
