Abstract
With a view to preventing and remedying environmental damage, the present Act lays down provisions relating to environmental liability based on the “polluter pays” principle. The Act applies do damage inflicted on water and on land. The text consists of 14 articles as follows: Purpose (1); Sphere of application (2); Exceptions (3); Definition of terms (4), Preventive measures (5); Restoration activities (6); Fixation of restorative measures (7); Cost resulting from prevention and restoration activitites (8); Duty to ascertain certain facts (9); Transboundary environmental damage (10); Environmental complaints and reclamations (11); Legal remedy (12); Penalties (13); Implementation of EU-directives (14). Four Annexes are enclosed.
