Abstract
This law is a comprehensive legal framework governing spatial planning in the Austrian state of Tyrol. It is aimed at promoting an orderly, sustainable development of the region that balances environmental, economic, and social interests. The law outlines principles and goals such as protecting natural resources, ensuring efficient land use, preventing urban sprawl, supporting local economies, and safeguarding against natural hazards and industrial risks. It establishes procedures for over-regional and local spatial planning, including mandatory environmental assessments and public participation. It also includes rules for zoning (e.g., residential, agricultural, commercial), land use planning, and development controls.
The legislation details responsibilities at different government levels, the creation of spatial planning programs (including for shopping centers and tourism infrastructure), and oversight mechanisms. Special provisions are included for managing second homes, regional planning associations, and urban development. It also addresses the restructuring of plots (land consolidation), the role of the Tyrolean land development fund, and transitional arrangements. Multiple amendments and transitional rules reflect the law’s evolution in response to environmental directives, urbanization needs, and events like the COVID-19 pandemic.
