Abstract
The law overarching goal is to protect agriculture, horticulture, and biodiversity from the economic and ecological threats posed by invasive plant pests. The text establishes a legal framework for protecting plants and plant products in Tyrol from harmful pests. It grants authorities the power to monitor, investigate, and respond to pest outbreaks by enforcing EU regulations, including the establishment of control zones, mandatory reporting, and implementation of phytosanitary measures. The law outlines the responsibilities of landowners, businesses, and transport operators to comply with inspections, allow access for sampling, and carry out pest control actions. It also permits pest containment for scientific or educational use under strict conditions and mandates coordination with other jurisdictions if pest zones cross borders. The law enables the transfer of certain duties to qualified public or private entities and includes provisions for local governments to assist in pest management efforts. The legislation ensures alignment with EU laws, particularly Regulation (EU) 2016/2031. The text consists of 15 Articles.
