Abstract
The object of this Act is to make a law for the government of certain Territories in relation to the evaluation, registration and control of agricultural chemical products and veterinary chemical products. The 26 sections of the Act are divided into 8 Parts: Preliminary (1); The AGVET Code and the AGVET Regulations of the participating Territories (2); Citing the AGVET Code and the AGVET Regulations (3); Application of AGVET Codes to the Crown (4); Performance of functions that corresponding States confer on Commonwealth authorities and officers (5); Jurisdiction of courts (6); Miscellaneous (7); Imposition of fees and taxes (8).
The Act applies to participating Territories, as defined by sections 4, 5 and 6. The AGVET Code set out in the Schedule to the Agricultural and Veterinary Chemicals Code Act 1994 as in force for the time being applies as a law for the government of the participating Territories. Australian Pesticides and Veterinary Medicines Authority (APVMA) may determine for purposes of Part 8 of the AGVET Code of the participating Territories written principles to be observed in the manufacture of chemical products (sect. 23). The Regulations in force under section 6 of the Agricultural and Veterinary Chemicals Code Act of 31 August 1996 apply as regulations in force for the purpose of the Agricultural and Veterinary Code set out in the Schedule of the Act (the "AGVET Code") (sect. 8). The AGVET Code of participating Territories shall apply as law for the government of such Territories (sects. 7 and 9). Section 10 deals with the relationship between the AGVET Code and AGVET Regulations of the participating Territories and the laws of a participating Territory.
