Abstract
This Regulation, consisting of 14 Parts and one Schedule, establishes the following issues: Part 2 Protection of animals and plants (including marine mammals and prohibited vessel' operations to protect these animals); Part 3 Areas of outstanding biodiversity value (including criteria for declaring areas of outstanding biodiversity value); Part 4 Threatened species and ecological communities (including list of criteria and Restricted geographic distribution); Part 5 Provisions relating to private land conservation agreements (including criteria for determining land eligibility); Part 6 Biodiversity offsets scheme (including additional biodiversity impacts); Part 7 Biodiversity assessment and approvals under Planning Act (including clearing of native vegetation); Part 8 Biodiversity certification of land (including avoiding or minimising impacts of clearing and loss of habitat); Part 9 Public consultation and public registers; Part 10 Biodiversity Conservation Trust (including preparation and publication of Trust business plan); Part 11 Regulatory compliance mechanisms (including terms of interim protection orders); Part 12 Investigation powers (including retention, destruction or disposal of seized animals or plants); Part 13 Criminal and civil proceedings and Miscellaneous.
Schedule 1 deals with offences and penalties for illegal activities: For the purposes of section 13.5 of the Act: a) each offence specified in this Schedule is a penalty notice offence for which a penalty notice may be issued; b) the amount payable under any such penalty notice is the amount specified in this Schedule for the offence; and c) an authorised officer under Part 12 of the Act may issue any such penalty notice.
Entry into force notes
This Regulation enters into force on 25 August 2017.
