Abstract
This Regulation, consisting of 120 sections divided into nine Chapters, made under the Biosecurity Act 2015, regulates several sectors related to biosecurity, such as: animal production and marketing within the Australian territory. This Regulation is divided as follows: Preliminary (Chap. 1); Chapter 2 deals with 'Managing biosecurity risks: goods' and makes provision for and in relation to notices that must be given of goods that are, or are intended to be: a) brought into Australian territory; and b) unloaded at a landing place or port in Australian territory. Chapter 3 deals with 'Managing biosecurity risks: conveyances' and makes provision for and in relation to reports that must be given by an operator of an aircraft or vessel in the circumstances referred to in paragraph 193(1)(a) or b) of the Act. In particular, provides for and in relation to the following: a) information that must be included in a report; b) manner in which a report must be given; c) person to whom a report must be given; d) time at which, or period during which, a report must be given; e) exceptions to the requirement to give a report. Chapter 4 deals with 'Ballast water and sediment' and provides for the Management of discharge of ballast water.
Chapter 5 deals with 'Managing biosecurity risks: monitoring, control and response' and other biosecurity measures relating to goods or conveyances—export from Australian territory. Chapter 6 deals with 'Approved arrangements' including: requirements for approving proposed arrangement, and management of approved arrangement. Chapter 7 deals with 'Compliance and enforcement' including: period for paying an amount under certain infringement notices given at a first point of entry and amount payable under certain infringement notices. Chapter 8 deals with 'Governance and officials' providing for and in relation to: a) the process to be followed in conducting a review under section 567 of the Act; and b) the content of reports of reviews conducted under that section. Chapter 9 on 'Miscellaneous' deals with compensation for certain animals destroyed at a post-entry quarantine facility; Managing biosecurity risks: Torres Strait; Permanent biosecurity monitoring zones; Protected zone area, etc.
