Abstract
This Plan, made under the Environmental Planning and Assessment Act 1979, consists of the following Parts: Preliminary (1); Permitted or prohibited development (2); Exempt and complying development (3); Principal development standards(4); Miscellaneous provisions (5); Additional local provisions (6). This Plan aims to make local environmental planning provisions for land in Botany Bay in accordance with the relevant standard environmental planning instrument under section 33A of the Act. (2) The particular aims of this Plan are as follows: (a) to recognise the importance of Botany Bay as a gateway to Sydney, given its proximity to Sydney (Kingsford Smith) Airport and Port Botany, (b) to encourage sustainable economic growth and development, (c) to provide direction concerning growth and change in Botany Bay, (d) to identify and conserve those items and localities that contribute to the local built form and the environmental and cultural heritage of Botany Bay, (e) to protect and enhance the natural and cultural landscapes in Botany Bay, (f) to create a highly liveable urban place through the promotion of design excellence in all elements of the built environment and public domain, (g) to protect residential amenity. In addition, the Plan is completed by five Schedules specifying the use of certain lands.
Entry into force notes
This Plan enters into force on the day on which it is published on the NSW legislation website.
Notes
All local environmental plans and deemed environmental planning instruments applying only to the land to which this Plan applies are repealed. While Botany Local Environmental Plan 1995 no longer applies to the land to which this Plan applies, it continues to apply to the land identified as “Deferred matter” under clause 1.3 (1A).Last amendments up to Standard Instrument (Local Environmental Plans) Amendment (Flood Planning) Order 2021 (2021-226).
