Abstract
These Regulations are organized in 10 Parts. Part 2 provides that if a person knows, or suspects, that a site is contaminated a report must made under section 11 of the Contaminated Sites Act 2003 (the Act),musing the form provided in the Regulations (Form 1). Part 3 concerns public access to information and documents; request for access to a summary of records can be done using Form 2.
Part 4 provides details on the establishment, procedures for conflict of interest and other matters, and term of office of members of the Contaminated Sites Committee. Part 5 regulates decisions as to responsibility for remediation. The Part identifies the interested persons; the form for a request for decision as to responsibility for remediation; the facts and circumstances to be taken into account by the Committee in making a decision as to responsibility for remediation. Part 6 concerns certificates of contamination audit. Part 7 clarifies when mandatory auditor’s reports are required. Part 8 provides that disclosure statements under section 64 of the Act need to be made using Form 5 and accompanied by certain further information. Part 9 — Auditors, regulates application, accreditation, functions, reporting duties and disciplinary matters.
