Abstract
The main purposes of this Act are to combat and reduce the incidence of organised crime; to improve continuously the integrity of, and to reduce the incidence of misconduct in, the public sector; and to facilitate the exercise of the Commission’s functions under the Criminal Property Confiscation Act 2000. “Misconduct” is defined by section 4 and could be also minor or serious misconduct.
Part 2 establishes the Corruption and Crime Commission indicating qualifications required for Commissioner, terms and conditions of service and the Commissions functions. The functions include general function, serious misconduct function, functions in relation to Police Royal Commission, functions in relation to organised crime functions, prevention and education function and capacity development function. The Act then continuous providing further rules on the role of the Commission for serious misconduct (Part 3), role of the public sector commissioner (Part 4A), exceptional powers and fortification removals in the occurrence of organised crime (Part 4), reporting duties (Part 5), additional powers to require information or attendance, entry and search, and assumed identities (Part 6), powers for Examinations and deciding claims of privilege and excuse (Part 7), arrest warrants (Part 8). Part 9 concerns provisions on disclosure, secrecy and protection of witnesses. Part 10 and 11 cover respectively contempt and offences. Part 12 contains administration of the Act.
Part 13 and Schedule 3 introduces the figure of the Parliamentary Inspector of the Corruption and Crime and establish term and condition of services, powers, functions and other matters related to its role.
Part 13A rules that the Houses of Parliament are to establish a committee under the name of the Joint Standing Committee on the Anti Corruption Commission committee comprising an equal number of members appointed by and with the scope of carry on the functions conferred under this Act; and (b)have the same powers with respect to the Commission and the Parliamentary Inspector as it has with respect to the Anti Corruption Commission.

Long title: An Act to provide for the establishment and operation of a Corruption and Crime Commission with functions with respect to serious misconduct by public officers and organised crime and with respect to the confiscation of unexplained wealth and criminal benefits; and confer on the Public Sector Commissioner functions with respect to misconduct by public officers; and provide for the establishment and operation of a Parliamentary Inspector of the Corruption and Crime Commission.
