Abstract
The Environmental Protection Regulations implement the Environmental Protection Act 2019. The text of these Regulations is composed of 12 Parts and 2 Schedules. Part 1 and 2 concern preliminary matters and list important concepts and definitions.
Part 3 (Environment protection declarations) sets out processes for preparing: declaration, review, amendment and revocation of environmental objectives and referral triggers (Division 1), permanent declaration of a protected environmental area and declaration of a prohibited action or class of prohibited actions (Division 2).
Part 4 (Referrals of proposed actions and strategic proposals) lays down the rules for considering and dealing with a referral of a proposed action for a standard assessment under section 48 or 50(2)(c) of the 2019 Act; (b) a referral of a strategic proposal for a strategic assessment under section 49 of the 2019 Act.
Part 5 (Environmental Impact Assessment) concerns different possible assessment types: Assessment by referral information (Division 4); Assessment by supplementary environmental report (Division 5); Assessment by environmental impact statement process (Division 6); and Assessment by inquiry (Division 7).
Part 6 concerns the Assessment Report, the Report that Northern Territory Environmental Protection Authority (NT EPA) must prepare on completion of an environmental impact assessment process. The assessment report is to be given to the Minister and its purpose is to assess whether the proposed action or strategic proposal is likely to meet the environmental objectives, to assess the potential significant environmental impacts, to make recommendations for avoiding, mitigating and managing those impacts, and to advise the Minister as to the environmental acceptability of the proposed action or strategic proposal.
Part 7 regulates the situations when a significant variation to the proposed action or strategic proposal is notified to the NT EPA before the preparation of the assessment report for the Minister.
Part 8 concerns claims on Environmental protection bonds. Part 9 coordinates the discipline for registration of environmental auditors and environmental practitioners. It outlines conditions, process for applying, registration, renewal and suspension and situations when the decision can be reviewed.
Part 10 indicates the relevant information about an environmental incident required to be notified to the CEO. Part 11 regulates infringement notices and offences establishing when the notice can be given, its content and forms of payment.
