Abstract
The Environmental Protection (Bilateral Agreements) Regulations 2021 were enacted under Western Australia's Environmental Protection Act 1986. They outline the procedures for handling matters as bilateral applications when functions performed by state entities under a bilateral agreement may impact the Commonwealth Environment Act. The Regulations specify that applications must be submitted in writing and, if applicable, using an approved form containing the required information. They also include transitional provisions for certain clearing permit applications made under the bilateral agreement established in 2014 between the State and the Commonwealth. The Regulations came into effect in alignment with the commencement of specific provisions in the Environmental Protection Amendment Act 2020.
