Abstract
The Regulations are divided into the following Parts: Preliminary (1); Fishing Activities of a Prescribed Class (2); Protected Fish (3); Sale, Purchase or Possession of Fish (3A); Devices (4); Protection of Aquatic Habitat (5); Distinguishing Marks on Boats (6); Undersize Fish (7); Mutilated Fish (8); Provisions relating to Abalone Fishing (9); Facilitation of Proof (10); Miscellaneous (11).
The Regulations implement various sections of the principal Act regarding inter alia the following: identification of fishing activities of a prescribed class; declaration of protected fish species; definition of undersize fish (reg. 21) and identification of minimum size for single fish species; technical requirements and procedure for the registration of fishing devices; allotment of distinguishing marks to registered boats by the Director; enforcement measures. Specific provisions regard abalone fishing, with respect to licensing, fishing methods, size, etc. As far as the protection of the environment is concerned, Part 5 establishes the conditions under which a person may discharge, release or deposit in the waters of the State the substances listed in regulation 16(2).
The Regulations are completed by ten Schedules: (1) Fishing activities of a prescribed class for the purposes of section 41 of the Act; (2) Areas in which use of fish nets prohibited (Schedule 1, clause 24); (3) Areas and carrying of explosive devices when diving (reg. 13(3)); (4) Rock lobster removal of middle tail fan (reg. 35E); (5) Fees; (6) Undersize fish (reg. 22); (7) Methods of Measuring Lengths; (8) Species of fish prescribed for the purposes of section 48G of the Act; (9) Classes of fish prescribed for the purposes of section 44(4) of the Act; (10) Expiation of Offences.
Furthermore, the Regulations contain two Appendixes, regarding the legislative history and the divisional penalties and expiation of fees, respectively.
