Abstract
These Regulations, consisting of 30 sections and completed by ten Schedules, implement the Fisheries Management Act 2007 by providing specifications on several matters related to fisheries management. In particular, the regulations cover the sale, purchase and possession of aquatic resources; the registration of devices for non-commercial fishing and recreational uses; marking of fishing vessels; the management of specific fisheries and the management of lobsters; etc.
The Regulations are divided as follows: Commercial quantity; Corresponding laws; Protected species; Classes of fishing activities prescribed for purposes of section 70 of Act; Sale, purchase or possession of aquatic resources; Possession of prescribed quantity of aquatic resource in prescribed circumstances; Aquatic or benthic animals; Registration of devices for non-commercial fishing; Duty to produce certificate of registration; Section 53(2) of Act not to apply to rods and lines and hand lines used for commercial fishing; Requirements relating to buoys and tags; Carriage of explosive devices in specified areas; Carriage of certain devices while using scuba etc.; Carriage of devices near lock and weirs of Murray River; Distinguishing marks on boats; Mutilation of certain fish; Provisions relating to abalone fishing; Keeping of fish in corfs; Keeping of rock lobster; Taking rock lobster or setting rock lobster pots in Northern Zone during closed season; Duty to clip tail fan of rock lobster; Berleying; Commercial bait nets not to be left unattended; Requirement to remove anchors etc from nets removed from Lakes and Coorong Fishery; Marking of receptacles in which aquatic resources are transported, consigned for sale etc.; Notice of seizure of device; Duty to notify Minister of change of address; Evidentiary provision; Expiation of alleged offences.
