Abstract
These Regulations are organized in 6 Parts. Part 2 provides for the discipline of the Heritage Council of Western Australia; it regulates how Council is constituted, deals with conflicts of interest and Council meetings. Part 3 regulates the management of State Register of Heritage Places, sets the conditions for public inspection and form and content of register. Part 4 concerns repair notices
Part 5 considers proposals affecting places of heritage interest and make exemptions from requirement to refer proposal sunder section 73 of the Heritage Act 2018 (The Act) and clarifies the discipline on other matters, such as advice and notification of decision on referred proposal: sections 74 and 75 of the Act, etc. Part 5A, valuation of land, establishes what matters affecting land use or development need to be taken into account to evaluate land and applies when, under section 82(1)(a) of the Act, the Valuer-General takes into account restrictions on the use of land arising out of (a) the entry of the land in the register; or (b) a heritage agreement to which the land is subject. Part 5B establishes that Guidelines issued under section 105(1) of the Act, and amendments to and revocations of guidelines made under section 105(3) of the Act, must be published on the Council’s website.
Part 5C regulates State government heritage; it establishes the way in which assets can be prescribed as heritage, and their disposal. Part 5D recognizes compensation rights in relation to work prohibition.
