Abstract
The main purpose of this Act is to establish the Independent Broad-based Anti-corruption Commission (IBAC). This Act also amends the Parliamentary Committees Act 2003 to constitute a Joint House Committee of the Parliament of Victoria to oversee the Independent Broad-based Anti-corruption Commission. Corrupt Conduct is defined by Section 4 under Part 1. The objects of this Act are to provide for the identification, investigation and exposure and assist in the prevention of corrupt conduct and police personnel misconduct. The Act also aims at facilitating the education of the public sector and the community about the detrimental effects of corrupt conduct and police personnel misconduct on public administration and the community and the ways in which corrupt conduct and police personnel misconduct can be prevented.
Part 2 establishes the IBAC, its constitution, functions, powers, Commissioner’s appointment and duties, and other staff functions and powers. Division 2 regulates disclosure by the IBAC, division 3 confidentiality notices, and Division 4 protection of persons and documents.
Part 3 lays down provisions on investigations providing procedures for complains, information and notification to the IBAC, obligations of IBAC on these matters. The IBAC may conduct preliminary inquiry (Division 3A). Division 4 regulates how IBAC has to carrying out investigations.
Part 4 concerns Investigative powers and Part 5 contains authorization to possess, carry and use, acquire, store, maintain or dispose defensive equipment and firearms for investigating certain corrupt conducts and police misconduct. Defensive equipment and firearms. Part 6 concerns Examinations; Part 7 Recommendations, actions and reports; Part 8 budget, annual plan and performance audit.
