Abstract
The purpose of this regulation is to provide for the waiver and deferral of rent and the deferral of instalments in response to the COVID-19 emergency. The purpose is achieved by (a)providing for the waiver of the payment of rent for eligible tenures under part 2; and (b)providing for the Minister to decide, under part 3, to (i)waive the payment of rent for particular tenures; and (ii) defer the payment of rent or instalments for particular tenures.
The eligible tenures under Part 2 fall under different rental categories; among those the regulation applies also to primary production (11.1 and 11.2 – these include aquaculture, viticulture and agriculture) and businesses (13) leases, licences and permits.
Part 4, Division 4 concerns Relationship with Land Regulation 2009. The Division clarifies that if there is an inconsistency between a provision of this regulation and a provision of the Land Regulation 2009, the provision of this regulation prevails to the extent of the inconsistency.
