Abstract
The Act is organised in 10 Parts. Part 2 contains general rules affecting property, such as lands lie in grant, suits for possession of land by mortgagors, power to dispose all rights of land. The Part states that all rights and interests in land may be disposed of, including— (a) a contingent, executory, or future interest in any land, or a possibility coupled with an interest in any land, whether or not the object of the gift or limitation of such interest or possibility be ascertained; (b) a right of entry, into or upon land whether immediate or future, and whether vested or contingent.
Part 3 provides general rules affecting contracts, conveyances, and other instruments. The Act establishes that contracts for sale of land to be in writing, conveyances of land or of any other interest should be made by deed. The Act also provides a list instruments required to be in writing. Part 4 contains the discipline of mortgages. Part 5 regulates powers. Part 6 concerns class closure, perpetuities and accumulations. Part is on apportionment. Part 8 encompasses partition. Part 9 provide discipline for voidable dispositions.
