Abstract
This Regulation implements the Marine Parks Act 1997 by providing specifications on matters related to the creation and management of marine parks. In particular, the Regulation prescribes certain offences as penalty notice offences and includes various miscellaneous provisions relating to the Marine Parks Authority. It introduces new powers to seize boats and motor vehicles that a marine park ranger has reason to believe have been used by a person engaged in commercial fishing activities for the purposes of committing certain offences. These offences are known as forfeiture offences, and the Regulation lists those offences under the Act and Regulations which constitute forfeiture offences.
It also deals with general matters such as consents - for example, certain activities are prohibited within marine parks without the consent of the relevant Ministers - as well as the processes for obtaining such consents.
