Abstract
The Act gives effect to obligations of the Commonwealth to the International Convention on Civil Liability for Oil Pollution Damage, 1969.
The provisions of the Act are divided into 7 Parts: Preliminary (I); Liability and limitation of liability under Convention (II); Insurance certificates relating to liability for pollution damage (III); Proof of possession of adequate insurance cover by certain ships (IIIa); Recovery of expenses of Minister under Protection of the Sea (Powers of Intervention) Act 1981 (IV); Recovery of loss etc. incurred by the Australian Maritime Safety Authority because of discharges from ships (IVA); Miscellaneous (V).
The Act is completed by 2 Schedules containing the text of the Convention and the Protocol to the Convention. Section 7 outlines the application sphere of provisions relating to liability or limitation of liability with regard to laws of a State or the Northern Territory.
