Abstract
The Reserves Act 2023, enacted by the Parliament of Western Australia, is a legislative framework designed to modify the status, purpose, and classification of certain reserved lands within the state. Receiving assent on November 28, 2023, the Act is structured to take effect in stages, with specific provisions commencing upon Royal Assent and others on dates set by proclamation. This Act binds the Crown in Western Australia and, within the Parliament's legislative authority, the Crown in all other capacities. Key terminology, such as "class A reserve," "national park," and "Deposited Plan," is defined to ensure clarity in interpretation and application. The Act grants the Registrar of Titles the authority to implement necessary registration measures to reflect the amendments it introduces. These include changes to the composition and designation of class A reserves. Specific areas within these reserves are excised and reclassified for new purposes. For example, Reserve 48470 undergoes significant modification with portions being excised and subsequently reclassified as a national park, ensuring their preservation under the Land Administration Act 1997. Other notable amendments include the cancellation of class A Reserve 24591, which is redefined to benefit the Yamatji people socially, culturally, and economically as part of the Yamatji Nation Indigenous Land Use Agreement. Additionally, the purpose of class A Reserve 39820 shifts from "Conservation Park" to a national park to align with new objectives.
