Abstract
The Regulations are organized in 6 Parts. Part 2 contains provisions concerning rural fire brigades and groups of rural fire brigades. The Part requires them to have a constitution; prescribes the content of the Constitution and the form; membership, including probation, removal and appeal; disciplinary action; etc. Part 3 regulates Bush Fire Management Committees; Committee must not be incorporated, or be a committee of a council under the Local Government Act 1993 and has the function to assist the Bush Fire Co-ordinating Committee (Section 51 of the Rural Fires Act 1997, the Act).
Part 4 Fire prevention, makes regulations for section 135 of the Act. The Part prohibits to light a fire on land in connection with the demolition of a building, or the destruction of old building materials, or a similar purpose; the burning to destroy sawmill waste material is prohibited unless the fire is lit in an incinerator designed to prevent the escape of sparks and burning material, or on ground enclosed by a fence or in a pit dug following certain conditions; drive or use a steam-powered machine unless is not permitted unless the smoke box is fitted with a spark arrester, and the fire box is fitted with a tray constructed in a way that prevents the escape of sparks or burning material from the fire box, and they meet certain conditions; moreover the use of motorised machines and implements likely to generate spark is prohibited in connection with an agricultural, pastoral or similar land use; roadside fire protection is also regulated. Further prohibitions are limited to the bush fire danger period; for instance burning garbage and refuse; Lighting fires to produce charcoal or distill oils; Lighting fires for cooking, etc.
Part 5 regulates Notice, such as public notice of draft bush fire risk management plans, notice of intention to burn off or burn fire break, notice of issue of fire permit, etc.
