Abstract
The aim of this development instrument is to promote and encourage sustainable agriculture and aquaculture by facilitating the allocation of land between primary production and residential development while having regard to social, economic and environmental considerations and ensuring protection of native vegetation, biodiversity and water resources. The Act is divided in 5 Parts and 6 Schedules (schedule 6 is repealed) and Part 1 covers preliminary provisions.
Part 2 briefly recognises the importance of identifying State significant agricultural land to ensure that is protected and developed; schedule one should have listed the lands but the list is up to this date black.
Part 3 lays down the discipline of farm dams and other small-scale and low risk artificial water-bodies in lands within the area of operations of irrigation corporations; the section lists development, maintenance of supply or drainage channel, and other emergency work activities for which is not required consent.
Part 4 entails provisions concerning the livestock industry; for instance, it identifies the forms of development aimed at temporarily contain livestock that are permissible without consent.
Part 5 sets the discipline for sustainable aquaculture; it encourages sustainable marine waters aquaculture and sets out the minimum site location and operational requirements for permissible development for the purpose of marine waters aquaculture, it establishes a regime for categorising development for the purpose of aquaculture based on the applicable level of environmental risk associated with site and operational factors (including risks related to climate change, in particular, rising sea levels) and to identify certain categories of development as designated development, and requires consent authorities to take into consideration the effect of development on existing and future oyster aquaculture development and oyster aquaculture areas when assessing development applications.
