Abstract
The main purpose of this Act is to confer additional functions and powers on the Victorian Plantations Corporation (the Corporation), a State body established under the State Owned Enterprises Act 1992 and to make further provision for the management of plantations. Part 2 encompasses the additional powers conferred to the Corporation.
Part 3 concerns plantations and regulates under Division 1 vested land; the aspects that are considered are vesting of plantations in Schedule 1 and further vesting of plantations, divesting of land from the Corporation, land deemed never to have been vested. The Part also confirms that except as otherwise provided for in the amendments made to this Act by the Victorian Plantations Corporation (Amendment) Act 1994, the substitution of a plan in Schedule 1 by that Act does not affect the status of any land identified on the plan. Furthermore, the Act provides ruling for the consequences of vesting and access through vested land. Division 2 is on acquisition and disposal of land. Division 3 concerns the Corporation management powers on Crown land leased by the Secretary or other public authority. Division 4 contains general provisions encompassing property on forest produce (The Corporation owns forest produce on freehold land and vested land), harvesting timber (Before taking, or permitting the taking, of forest produce from land to which a planning scheme applies, the Corporation must give written notice of its proposal to the municipal council, if the land is in a municipal district or in any other case, the Minister administering the Planning and Environment Act 1987) and a general prohibition of taking forest produce owned by the Corporation without a licence.
Part 3A regulates licenses; it covers licence grant, assignment, application, cancellation, power. Registration of licence and registrar appointment and functions as well find regulation in this Part. Part 4 contains general provisions, such as enforcement powers and regulation and jusrisdiction of Supreme Court. Part 5 lays down provisions for allocation of property, transfer of property and for staff of the Corporation.
