Abstract
These Rules are organised in 7 Parts. Part 2 sets requirements and procedures that irrigation infrastructure operator must follow to facilitate the transformation and implementation of these Rules. Part 3 establishes timing and content of information that the irrigation infrastructure operator must provide to the person who holds an irrigation right against an irrigation infrastructure operator when the person gives written notice that intends to apply, or applies, for transformation of the whole or a part of that right. These information include details of the contractual or other arrangements such as the number of units or volume of water to which the person is entitled under the irrigation right as at the date of receipt of the notice.
Part 4 regulates contractual terms and conditions of water delivery rights. Rule 8 establishes that when a person who holds an irrigation right against an irrigation infrastructure operator gives written notice to the operator for transformation of the whole or a part of that right, and requires the continuation of a right to have water delivered by the operator after transformation the operator must provide details of the contractual terms and conditions, indicating variations (if any) to take effect from transformation. The Part continues ruling that the operator must not make any variations other than variations that are necessary as a consequence of the transformation or agreed in writing. Part 5 regulates applications relating to transformation of irrigation rights. Part 7 concerns proceedings to recover loss or damage.
