The Wildlife (Marine Mammals) Regulations 2019 (Victoria) establish a statutory framework for the protection and management of marine mammals, including whales, dolphins, and seals. These regulations are made under the Wildlife Act 1975 and came into effect on 23 November 2019, replacing the 2009 regulations. The primary objective is to ensure long-term conservation of marine mammals by regulating human activities in their vicinity. This includes the imposition of minimum approach distances for aircraft, vessels, and individuals, with specific provisions for narrow waterways, sanctuary zones, and breeding colonies. Certain exemptions apply, notably for emergency services, authorised officers, and individuals acting under relevant permits. The regulations also designate protected areas such as whale sanctuary zones and seal breeding colonies, with restrictions on entry and proximity. Entry into Logan’s Beach Exclusion Zone is prohibited during the whale migration season unless otherwise authorised. Operational conduct around marine mammals is strictly regulated. Prohibited behaviours include approaching from certain angles, separating individuals from groups, feeding, touching, making loud noises, and allowing dogs near marine mammals. Vessels and aircraft must avoid causing disturbance and must withdraw if signs of distress are observed. Commercial tour operators are subject to detailed permit conditions. These include requirements for public education, supervision, signage, and operational limitations. Whale swim tours are subject to additional restrictions, including the use of mermaid lines, limitations on proximity and duration, and prohibitions during mating or calf presence. Prescribed fees apply to various permits, with whale swim tours attracting higher charges. Permit holders are required to maintain monthly records of tour activities and submit returns to the Secretary. Electronic submission may be mandated.
