Abstract
This Law regulates relations related to the insurance of risks in the agricultural sector in Azerbaijan through a joint insurance mechanism, and determines the legal, economic and organizational foundations of agricultural insurance. The state's responsibilities in implementing agricultural insurance are as follows: (i) to determine the scope of agricultural insurance and agricultural insurance risks; (ii) to determine the directions of state policy in the field of agricultural insurance and adopt regulations; (iii) to implement stimulating measures to expand activities in agricultural insurance; (iv) to organize training and disseminate information to expand the application of agricultural insurance; (v) to monitor the implementation of the agricultural insurance system and provide support to ensure its continuity; (vi) to ensure the implementation of measures to promote the development and use of the agricultural insurance system; (vii) to support international cooperation in the field of agricultural insurance.
In accordance with the requirements of this Law, the scope of agrarian insurance include: agricultural plants and plant products (including perennial crops and their products); livestock and animals bred for agricultural purposes; and aquaculture products. Agricultural products whose production, processing, import and sales are prohibited, as well as sick animals (livestock) and aquaculture products in the territory where quarantine and restriction measures are applied, cannot be the subject of agricultural insurance. The procedure for complying with this requirement shall be determined by the insurance rules. The producers of agricultural products are insured against one or more of the following risks under agricultural insurance in accordance with the insurance rules: (a) natural disasters; (b) fires; (c) plant diseases and pests; (d) infectious diseases and poisoning; (d) attacks by wild animals and the spread and attack of particularly dangerous pests; and (e) actions of third parties.
An agricultural insurance information system shall be created by the agricultural insurance authority in order to electronically conduct the actions of entities related to agricultural insurance, electronically organize the agricultural insurance product, register insured persons and implement operational control over the services provided. The agricultural insurance authority obtains the following information and documents in real time through electronic information systems: 1. on weather and climate conditions; 2. on irrigated lands, land reclamation and irrigation networks, hydrotechnical facilities, pumping stations, subartesian wells, and salinization; and 3. on the legal status of agricultural lands, ownership, use and lease rights over land, quantitative and qualitative indicators of lands, land assessment and economic evaluation, other information determined by law regarding the use and protection of land, other real estate (buildings and structures) used for agricultural purposes, registered rights over that real estate, encumbrance (restriction) of rights, information about right holders.
