Abstract
This Law regulates the classification, labelling and packaging of chemicals; safety data sheet; performing activities with chemicals; integrated chemical inventory; restrictions and prohibitions on chemicals; conditions for import and export of chemicals; placing detergents on the market; integrated chemical management; supervision and other issues of importance for the safe management of chemicals in the Federation of Bosnia and Herzegovina.
The text is divided into thirteen main Chapters and a total of 61 articles. Titles of Chapters are as follows: I. Basic provisions; II. Classification, labelling and packaging of chemicals; III. Safety data sheet; IV. Performing activities with chemicals; V. Integrated chemical inventory; VI. Restrictions and prohibitions of chemicals; VII. Conditions for import and export of chemicals; VIII. Placing the detergent on the market; IX. Integrated chemical management; X. Special provisions; XI. Supervision; XII. Penal provisions; XIII. Transitional and final provisions.
This Law is based on the principle that the manufacturer, importer or downstream user should ensure that they produce, place on the market or use substances that do not have a harmful effect on human health and the environment. The provisions of this Law are based on the precautionary principle and it fulfills the preconditions for the implementation of the Globally Harmonized System of Classification and Labeling of Chemicals of the United Nations, the Rotterdam Convention on the Prior Informed Consent Procedure for International Dangerous Chemicals and Pesticides in International Trade (hereinafter: the Rotterdam Convention) and other international agreements and initiatives aimed at the safe management of chemicals. General exceptions and special exceptions to the application of this Law are listed in articles 5 and 6. Good laboratory practice is defined in article 11. Prior notification procedure is subject of article 38. Cooperation with the designated BiH Rotterdam Convention implementation body is defined in article 39. The Parliament of the Federation, at the proposal of the Government of the Federation, adopts the Strategy of Chemical Safety of the Federation, in order to efficiently and transparently implement policies in the field of safe management of chemicals, public health and environmental protection (article 44). Based on the chemical hazard assessment and related established criteria, chemicals are classified into certain hazard classes according to their physical properties, properties that affect human health, as well as properties that affect the environment. In order to ensure adequate management of chemicals, the Government of the Federation of Bosnia and Herzegovina shall establish a Joint Working Body for integrated management of chemicals. A joint working body shall be established by representatives of the federal ministries responsible for health issues; agriculture, water management and forestry; environment and tourism; work; internal affairs; industry, energy and mining; trade and entrepreneurship and representatives of the Institute of Public Health of the Federation of Bosnia and Herzegovina.
